It is practically certain that Maryland voters will decide the fate of marriage equality in an upcoming election, based on signatures opponents have collected.

Anti-marriage equality activists turned in what they claimed were more than 113,000 signatures of people in favor of a referendum on marriage equality. This is more than twice what was needed to get on the ballot in November. 

Same-sex marriage nearly always fails when it comes down to popular vote, and gay rights activists are trying to downplay the number of signatures collected by calling attention to polls that show more people in Maryland in favor of marriage equality.

Kevin Nix, a spokesman for Marylanders for Marriage Equality, said his group would not rule out court challenges to the signatures, if merited. But he said supporters of same-sex marriage have always been focused on winning at the ballot in November.

“It’s always been going to happen,” Nix said, referring to opponents’ ability to gather enough signatures to force a referendum.

Ugh, this is nerve-wracking. Maryland, get ready to get out the vote.

The First Circuit US. Court of Appeals has ruled that the federal Defense of Marriage Act is unconsitutional in one of the most closely watched gay-marriage cases in the nation.

The ruling had been delayed in part when the Obama administration reversed itself in the case last year. After first defending DOMA, the Justice Department then filed a revised brief dropping its defense.

The court decision Thursday in Boston found that the federal law forces states to discriminate against same-sex couples by not allowing them to grant federal benefits to gay spouses, even though they may be legally married under the states’ laws.

“[M]any Americans believe that marriage is the union of a man and a woman, and most Americans live in states where that is the law today. One virtue of federalism is that it permits this diversity of governance based on local choice, but this applies as well to the states that have chosen to legalize same-sex marriage,” the court wrote in its opinion. ”Under current Supreme Court authority, Congress’ denial of federal benefits to same-sex couples lawfully married in Massachusetts has not been adequately supported by any permissible federal interest.”

The court stayed its decision ”[a]nticipating that certiorari will be sought and that Supreme Court review of DOMA is highly likely.”

As much as I appreciate it when the media doesn’t sensationalize trans* people (especially children) in over-the-top, invasive write-ups, even the most calmly written article loses major points for misgendering.  As far as I’m aware, there isn’t a single article about Tyler that doesn’t either misgender him or refer to trans* people as being “transgendered”.  Even HuffPost’s “Gay Voices” section uses “transgendered”.  Then again, what else can be expected from a magazine that lumps the entire LGBTQ* spectrum into just the G?

  • When fellow trans* people use this term, I can't help but to think how hypocritical they sound. It's as if a gay person were to go around referring to heterosexual people as breeder fucks or as a cisgender person calling a trans* person trans trash. Identifiers being used as part of an insult shows that you find that identifier insulting. Your thoughts?
